Authorized Users

Current faculty members (including temporary, contract or exchange faculty for the duration of their assignment), enrolled post-graduate and undergraduate students, current staff members and contract personnel directly involved in educational and research activities of the Licensee who have been issued by the Licensee with a password or other currently valid authentication, together with other persons who are permitted to use the Licensee’s library or information service and access the Secure Network but only from computer terminals within the Licensed Site (including walk-in users).

Authorized Sites

The authorized site covered in this license is Western University of Health Sciences Pomona and Oregon campuses only. Authorized sites may be added or deleted from this agreement as mutually agreed upon by Taylor & Francis and Licensee.

If the Licensee (or any other company or entity that benefits from the license granted under this Agreement) (each, a “Beneficiary”) intends to merge with or acquire any interest or shares of a third party or any third party intends to merge with or acquire such an interest in the Licensee or any Beneficiary (a “Transfer”); or should there be a material change to the Authorized User constituency by addition of affiliations, partnerships or additional Licensed Sites, the Licensee shall give Publisher reasonable advance notice of any such change. Such notification must include details of all current Publisher subscriptions held by either Licensee or the merging institution, partner or affiliate. Licensee acknowledges that in such situations:

Publisher shall be entitled to offer to Licensee a revised Fee based on, amongst other things, the enlarged size and nature of the Licensee’s institution following the change (“Expansion Fee”); and

Unless and until Licensee pays to Publisher the Expansion Fee, Licensee acknowledges and agrees (and Licensee shall ensure as a principal obligation) that none of the employees, contractors or other personnel of the relevant third party shall have access to or use the Licensed Materials or shall be deemed to be Authorized User(s) under this Agreement

Permitted uses

Authorized Users may for educational and research purposes only:

  1. Search, view, retrieve and display the Licensed Materials;
  2. Electronically save individual articles or items of the Licensed Materials for personal use;
  3. Links to the Licensed Materials may be incorporated in Course Packs and Electronic Reserve collections, or other educational materials included in the Licensee’s learning management system. In addition the Licensee may use a maximum of ten (10) articles from the Licensed Materials in the preparation of any Course Pack used in the course of instruction at Licensee’s institution and for use by Authorized Users, but not for commercial use.
  4. Print off a copy of parts of the Licensed Materials.
  5. Fulfil occasional requests from other institutions, a practice called Interlibrary Loan. Licensee agrees to fulfil such requests via secure transmission and in compliance with Section 108 of the U.S. Copyright Act (17 U.S.C. §108, “Limitations on exclusive rights: Reproduction by libraries and archives”)
  6. Use the Licensed Materials to perform and engage in text mining/data mining activities for academic research and other non-Commercial Use, and mount, load and integrate the results on a Secure Network and use the results in accordance with this Agreement, provided that the Publisher is notified in writing in advance of the project to ensure that the Publisher can provide appropriate technical assistance and maintain a log of projects.
  7. In addition to the terms contained in this Agreement, Licensee acknowledges that use of the Licensed Materials shall also be subject to the Online Service Terms and Conditions of Use (the “Online Terms”). The Online Terms can be viewed at http://www.tandfonline.com/page/terms-and-conditions and that by accessing and using the Licensed Materials, Licensee acknowledges that they will be accepting and agreeing to be bound by them. 

Prohibited uses

Neither the Licensee nor Authorized users may:

  1. Remove or alter the authors’ names or the Publisher’s copyright notices or other means of identification or disclaimers as they appear in the Licensed Materials:
  2. Systematically make print or electronic copies of multiple extracts of the Licensed Materials, including complete issues, for any purpose:
  3. Mount or distribute any part of the Licensed Material on any electronic network, including without limitation the Internet and the World Wide
    Web, other than the Secure Network.
  4. Course Pack use on commercially run courses, whether organized by the member institutions, or another third party, is considered Commercial Use and as such prohibited.
  5. Share passwords with others or violate the terms and conditions http://www.tandfonline.com/page/terms-and-conditions.

The Publisher’s explicit written permission must be obtained in order to:

  1. Use all or any part of the Licensed Materials for any Commercial Use;
  2. Systematically distribute the whole or any part of the Licensed Materials to anyone other than Authorized Users:
  3. Publish, distribute or make available the Licensed Materials, works based on the Licensed Materials or works which combine them with any other material, other than as permitted in this License; and/or
  4. Alter, abridge, adapt or modify the Licensed Materials to Authorized users. For the avoidance of doubt, no alteration of the words or their order is permitted.

Scholarly Sharing
Authorized Users may fulfil such requests by transmitting to a third-party colleague in hard copy or electronically, minimal, insubstantial amounts of the Licensed Materials, but solely (a) for personal use or scholarly, educational, or scientific research or professional use, (b) in no case for re-sale, and (c) in all cases subject to Prohibited Uses above.

Copyright

Nothing in this Agreement shall in any way exclude, modify or affect any of the Licensee’s rights under the U.S. Copyright Act of 1976 as amended (17 U.S.C.§101, et seq.) or any statutory instruments made thereunder or any amending legislation.
